IT IS HEREBY AGREED that Insel Haus Retreat
Center, LLC, hereafter called, Insel Haus, located at HCR 1,
Box 157, Bois Blanc Island, Michigan 49775, does hereby let
and lease that portion of the Insel Haus premises described
in this agreement
to _______________________________________________,
located at ____________________________________________________,
hereafter called Tenant, for a term beginning______PM__________200__
and ending______AM__________200 . Said premises to be used for
private residential purposes only ( __ ) or as a retreat ( __
) or as a workshop ( __ ) and to be occupied by not more than
( ______ ) people.
DESCRIPTION OF LEASED PREMISES
Insel Haus first and second floors, Configuration ( __ ) - A,
B, C, D, E, F, G.
TENANT AGREES AS FOLLOWS
1. Pay to Insel Haus, LLC, as RENT ( $________USD ) per RENTAL
TERM. 50% ( $________USD) must be paid at time of confirmation
of reservation. Remaining 50% ($___________USD) and cleaning
deposit ($200.00 USD) shall be due 60 days prior to check-in.
2. Only _________ PEOPLE will reside in the premises, TENANT
agrees that should more than _________ PEOPLE occupy the premises,
Insel Haus will charge an additional $ 50.00 for each person
per day.
3. The premises will not be sublet nor assigned without the
written consent of Insel Haus.
4. Insel Haus is a smoke free environment. There shall be no
smoking on the premises.
5. No dogs, cats or other pets will be kept inside the house
without the written consent of Insel Haus.
6. The premises have been examined by the TENANT and have been
received in good condition and TENANT further agrees to maintain
the premises in the same condition as when received and will
not allow any waste, misuse or neglect.
7. Shelby or Christa Newhouse or an Insel Haus Agent shall function
as concierge to assist Tenant.
8. Alterations shall not be made to the premises, nor locks
be installed anywhere.
9. That no laws, statutes or ordinances of a jurisdictional
governmental unit will be violated on the premises.
10. That no motorized vehicles of ANY type will be placed inside
the leased premises at any time.
11. Any check or financial instrument returned to Insel Haus
by a financial institution shall subject the maker of such instrument
to a $100.00 FEE for each check returned.
12. That should any repairs be necessary, Insel Haus or the
concierge will be notified as soon as possible.
13. That should Insel Haus incur any expense in enforcing the
terms of this Lease, TENANT shall reimburse Insel Haus 100%
for such expenses.
14. Venue for litigation of this lease or portion thereof shall
be Mackinac County, Michigan.
LANDLORD AGREES AS FOLLOWS
1. Upon payment of the rents due by TENANT and TENANT’S
performance of his obligations under this Lease, TENANT shall
have use of the premises designated in this lease during the
term of the Lease.
2. In the event of an occurrance unrelated to actions of Tenant
or Tenant's guests, which makes the above described premises
untenable, Insel Haus shall declare this lease void and return
to Tenant, on a pro rata basis, that portion of monies due Tenant
for the unused portion of the lease.
3. Vehicles are not to be driven on the beach. Such actions
are illegal.
IT IS MUTUALLY AGREED AS FOLLOWS
1. TENANT shall be responsible for any damage to the grounds
surrounding the leased premises.
2. Insel Haus shall be responsible for providing one set of
pillows, blankets and/or comforters, bed linens, bath towels
& wash cloths per guest, dishes, glassware, silverware,
cooking utenslls, refrigerator, kitchen range, dish washer and
microwave, DISH TV receiver, Broad Band internet connections,
telephone equipment and fax machine.
3. Insel Haus shall be responsible for snow removal in the drive
and parking areas.
4. TENANT shall be responsible for cleaning Insel Haus rooms
prior to departure, unless tenant agrees to pay for cleaning
services supplied by management.
5. It is understood and agreed that both parties have read,
understood, and agreed to all of the foregoing and that they
agree that any infraction of the above provisions by Tenant
shall constitute a breach of this agreement and provide grounds
for immediate eviction and forfeiture of all moneys paid, including
deposit.
7. Furnishings, appliances, accessories, and any other items
provided with Insel Haus are not to be removed from the premises
or loaned at any time.
8. To encourage the use of the TENANT'S Telephone Credit Card,
it is agreed that ALL phone charges will be billed at 4 times
the actual amount of the billing, and paid by Tenant within
30 days of receipt of the billing from Insel Haus.
9. Insel Haus fees do not include travel. They are for lodging
only.
10. Other agreements are as follows:
CLEANING DEPOSIT
TENANT agrees to pay Insel Haus a $200.00 cleaning deposit to
be used by Insel Haus should additional cleaning beyond that
performed by the TENANT be required. Any additional cleaning
required is at the sole discretion of Insel Haus and/or the
Property Manager (concierge).
DAMAGE DEPOSIT
No damage deposit has been collected. The TENANT agrees to be
totally responsible for any and all damages caused by TENANT
or their guest(s). Further, the TENANT agrees to reimburse Insel
Haus with full payment within 10 days of departure for any and
all repair and/or replacement required to bring the property
back to the condition it was in at the lease starting date.
THIS AMOUNT WILL BE ESTABLISHED PRIOR TO TENANT'S DEPARTURE,
unless deemed otherwise by Insel Haus and/or Property Manager
(concierge).
CANCELLATION POLICY
If TENANT cancels 61+ days prior to TENANT'S reservation, Insel
Haus will refund 100% of monies deposited, minus a $50.00 service
fee. If TENANT cancels less than 60 days prior to reservation,
TENANT'S payment will be refunded only for the days that Insel
Haus was able to rebook.
A $50.00 service fee applies to all rebookings.
LEASE AGREEMENT
NOTICE: Michigan Law Establishes Rights and Obligations for
Parties to Rental Agreements. This Agreement is required to
comply with the Truth In Renting Act. If you have a question
about the legality of any provision of this Agreement, you may
want to seek assistance from a lawyer or other qualified person.
